PRIVACY POLICY

1. Scope of application

This Privacy Policy relates to the use of personal data for all individuals who communicate their personal details to Festival Ljubljana, Trg francoske revolucije 1, 1000 Ljubljana, which is also the controller of personal data.

We maintain high standards of personal data protection and aim to ensure that your data are adequately protected. In pursuing this goal, we adhere consistently to the present Privacy Policy.

2. Notice on the use and processing of personal data

The personal data controller is Festival Ljubljana, Trg francoske revolucije 1, 1000 Ljubljana.

The controller may use and process the personal data of a user of the website obtained upon registration as a member of the Ljubljana Festival Club or as a user of the e-newsletter, in accordance with the applicable regulations of the law governing personal data protection and the General Data Protection Regulation (GDPR; Regulation (EU) 2016/679).

From time to time prize competitions administered by another legal entity may be published on Festival Ljubljana’s website. The controller may use and process personal data obtained upon registration for the prize competition and acceptance of the terms and conditions of the prize competition, which will be published separately and which the user shall accept separately. Data collected for the purpose of organising a prize competition shall be kept for as long as is necessary for the implementation of the prize competition and the awarding of prizes or for as long as is determined by the legitimate interest of the controller.

Whenever the controller obtains personal data on the basis of consent, the consent must be the clear and specifically expressed wish of the data subject. Personal consent is a voluntary indication of the data subject’s wishes by which they agree that their personal data may be processed for a specific purpose, and is given on the basis of information provided by the controller. The personal consent of a data subject may be the written, oral or other appropriate consent of the individual concerned.

3. Scope of personal data processing and purpose of collection of personal data

Personal data processing means any operation or set of operations performed on personal data that are processed by automated means, are manually processed as part of a personal data filing system or are intended for inclusion in a personal data filing system, in particular collection, acquisition, entry, organisation, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, reporting, dissemination or otherwise making available, alignment or combination, restriction, anonymisation, erasure or destruction; processing may be performed manually or by automated means (means of processing).

The purpose of collecting, processing, keeping and using data is: statistical processing, segmentation of buyers, processing previous shopping behaviour, sending out special offers, promotional material and invitations to events, and for telephone, written and electronic surveys, notification about prize competitions organised by Festival Ljubljana or organised by another legal entity in conjunction with Festival Ljubljana.

In the case of use of the Festival Ljubljana website, the action of a user who, when registering as a member of the Ljubljana Festival Club, clicks the checkbox indicating consent for Festival Ljubljana to use personal data for the purposes specified and then clicks on the “Confirm” button to confirm that they accept and agree to the Privacy Policy, shall be considered personal consent.

In cases where the registration form is filled out on paper, the individual agrees, by signing the form, that their personal data may be used for the purposes set out in this Privacy Policy and that they agree with this Privacy Policy.

The controller shall process the following personal data of a user who has entered them in the registration form: first name and last name, street address, post code, town/city, email address, telephone number (landline), telephone number (mobile) and civil status (optional).

The controller shall use your personal data (first name and last name, address, email address, telephone number (landline or mobile) from the registration form for the purposes of operations involving the Ljubljana Festival Club card and use of the benefits which Festival Ljubljana offers Ljubljana Festival Club cardholders, for direct marketing purposes, including informing about events, new operational criteria and special offers from Festival Ljubljana, and to study shopping habits for the consequent implementation of targeted marketing, on the basis of which the user will be eligible for special, customised offers and benefits. Registration as a member of the Ljubljana Festival Club requires consent to the processing of the above personal data. Please note that you are only required to provide one telephone number which we can use to contact you in the case of emergencies such as the cancellation of events or in order to inform you in good time about special offers relating to individual events. 

Civil status is not a required field or condition for registration as a member of the Ljubljana Festival Club. This information is collected merely for the purpose of studying shopping habits and, consequently, to adapt offers with regard to the indicated status, on the basis of which users may be eligible for special, customised offers and benefits.

  • E-newsletter sign-up – Privacy Policy notice

You can sign up for the Festival Ljubljana e-newsletter by entering your email address on the www.ljubljanafestival.si website. Festival Ljubljana will use the e-newsletter to inform you about events, marketing activities and other promotions.

By signing up for the e-newsletter you also enrol in the database of recipients of benefits (discounts, prize competitions) which Festival Ljubljana reserves for e-newsletter recipients.

For the purposes of e-newsletter sign-up, Festival Ljubljana collects your email address, IP address and consent.

After submitting the sign-up form containing your email address, you will receive a confirmation email – by clicking on the link in the confirmation email you will be subscribed to the Festival Ljubljana e-newsletter until such time as you unsubscribe (“opt-in approval”). You can request the personal data controller to permanently or temporarily stop using your personal data for direct marketing purposes at any time, either in writing or by clicking the Unsubscribe from e-newsletter button. Your request will be approved within 15 days of receipt of the request at the latest.

You can also request the transmission of data or information about what data are held and exercise other rights in accordance with regulations. More about the Private Policy.

The personal data controller Festival Ljubljana undertakes to protect your data carefully in accordance with legislation regulating the protection of personal data.

4. Consent to processing of personal data

When a user registers as a member of the Ljubljana Festival Club and, in doing so, clicks the checkbox indicating consent for Festival Ljubljana to use personal data for the purposes specified and then clicks on the “Confirm” button to confirm that they accept and agree to the Privacy Policy, they shall be considered to have given the personal consent to the use and processing of personal data that is required under applicable regulations on the protection of personal data. On the basis of the user’s personal consent, the personal data controller may process the personal data for the purposes described in point 5.2.

Responsibility for the correctness, accuracy and up-to-dateness of the personal data submitted to the controller lies exclusively with the user themselves.

5. Right of the user to request the controller to stop using their personal data

A user may request at any time, either in writing or in another agreed manner (e.g. via email), that the personal data controller permanently or temporarily stop using their personal data for direct marketing purposes. The controller shall take adequate steps to block the use of personal data for direct marketing purposes within 15 (fifteen) days and notify the user who requested this either in writing or in another agreed manner (e.g. via email) within a further 5 (five) days.

6. Protection of personal data

When processing and handling a user’s personal data, the controller shall act in accordance with the requirements of regulations governing the protection of personal data.

For the purposes of protecting personal data, the controller shall use organisational, technical and other appropriate procedures and measures in order to prevent the unauthorised destruction of data, their alteration or loss, and their unauthorised processing. Since the Festival Ljubljana website contains links to other websites that are in no way affiliated to Festival Ljubljana, the controller assumes no responsibility for the protection of users’ data on these websites.

The controller likewise accepts no responsibility for errors that are the consequence of incorrect data being submitted on registration on the website or the communication of incorrect or incomplete data.

7. Storage period for personal data

Submitted personal data will only be stored and used for as long as is necessary in order to achieve the purpose for which they are processed. Once the purpose of processing has been fulfilled, the controller guarantees that the personal data will be erased or that access to collected personal data will be blocked.

The storage period is as follows:

  • Data submitted for the purpose of membership of the Ljubljana Festival Club are stored for the duration of membership;
  • Data submitted for the purpose of sending e-newsletters are stored until the individual unsubscribes.

8. Rights of the user

Festival Ljubljana guarantees the exercise of all rights of users in connection with the protection of personal data, in accordance with applicable regulations. 

Users may request the following from Festival Ljubljana at any time:

  • information as to whether personal data concerning you are being processed;
    • access to your own personal data (inspection and copy); in accordance with rules governing the charging of fees for the exercise of the individual’s right to information concerning their personal data, you will be charged a fee based on administrative costs for a copy of your data;
    • information regarding the processing of your personal data (purpose of processing, types of data, users of data, storage period);
    • rectification of inaccurate personal data and completion of incomplete personal data, which will be carried out in the shortest possible time from receipt of the request (“right to rectification” under Article 16 GDPR);
    • erasure of all personal data (“right to be forgotten”, if the grounds under Article 17 GDPR apply, particularly in the case of withdrawal of consent);
    • the restriction of processing if: (i) the accuracy of personal data is contested, for a period enabling the controller to verify the accuracy of the personal data; (ii) the processing is unlawful and you request the restriction of the use of the personal data instead of their erasure; (iii) the controller no longer needs the personal data for the purposes of the processing but you require them for the establishment, exercise or defence of legal claims; (iv) you have objected to the processing of your data pending verification of whether the legitimate grounds of the controller override those of the data subject;
    • exercise of the right to withdraw consent, where personal data are processed on the basis of your consent, where the withdrawal of consent does not affect the lawfulness of the processing of the personal data that has taken place up until the withdrawal of consent;
    • termination of the use of your personal data for direct marketing purposes;
    • the transmission of data in accordance with the conditions under Article 20 GDPR;
    • withdrawal of consent.

11. Dispute resolution and application of law

In the case of disputes arising from the use of this website or Festival Ljubljana e-newsletters, we will endeavour to resolve them amicably and as quickly as possible. If this is not possible, disputes will be settled by the competent court in Ljubljana.

The law of the Republic of Slovenia shall apply.

12. Validity

This Privacy Policy shall apply from the date of adoption and publication until revoked or amended.
